Fight over Initiative 101 continues

Seattle City Attorney Pete Holmes has filed a lawsuit against anti-tunnel measure Initiative 101 and Magnolia resident Elizabeth Campbell is calling the lawsuit  "a travesty" that deprives residents of their democratic right to vote on the pricey tunnel project. 

Campbell is the leader of Seattle Citizens Against the Tunnel effort that received enough valid signatures to qualify for the ballot.  King County Elections verified that the initiative has collected 21,173 signatures. 

Holmes said the initiative is beyond the scope of the city’s initiative power and interferes with the state’s authority to build a state highway.    Holmes wants a judge to declare the initiative illegal.  A hearing is likely next month.

I don?t believe Holmes has ever stated he wants the initiative declared illegal, he has simply stated that based on his interpretation of the law the initiative is illegal (if the project in question considered ?administrative? and is not eligible to the initiative process) and he has asked the courts to make a ruling. A lawsuit is the quickest way to get that done. If the courts decide it?s legal then off to the ballot boxes.

    The only travesty here would be if an illegal initiative is allowed to proceed and hold up the project any longer than it already has.
